BEFORE THE BOARD OF COLUMBIA COUNTY COMMISSIONERS |
RESOLUTION #2022-34 |
IN THE MATTER OF WINTER CLOSURES OF CERTAIN COLUMBIA COUNTY ROADS. |
WHEREAS, certain Columbia County roads are generally used only on a seasonal basis; and |
WHEREAS, these certain roads have a gravel or earth driving surface and are subject to unnecessary damage when used during winter months; and |
WHEREAS, climatic conditions require the closure of certain roads until such time as the County can restore the road to a passable condition; and |
WHEREAS, RCW 36.75.270 and RCW 46.44.080 provide that the Board of County Commissioners may by resolution limit or prohibit classes or types of vehicles on any county road; and |
WHEREAS, the Board of Columbia County Commissioners desires to restrict the use of certain county roads subject to unnecessary winter damage or climatic conditions. |
NOW, THEREFORE BE IT HEREBY RESOLVED, that |
1. The following designated county roads shall be closed to all wheel driven motor vehicles for a period of 270 days from the date of this resolution, PROVIDED, this order shall be in effect only when appropriate notice is posted at the termini of each restricted road or section thereof. |

2. The County Engineer is hereby directed to post restrictions as needed on the above designated roads. |
3. The County Engineer is hereby authorized to issue special permits for the operation thereon of vehicles transporting perishable commodities or commodities necessary for the health and welfare of local residents under such restrictions, as the County Engineer may deem necessary to protect the county road from undue damage. |
4. The County Engineer is hereby authorized to close any County road on an emergency basis for a period of 365 days from the date of this resolution, PROVIDED, this order shall be in effect only when appropriate notice is posted at the termini of each restricted road or section thereof. Whenever possible, closures are to be located where users can safely turn around upon arriving at the closure. |
5. Those persons having need for periodic and reasonable use of restricted roads for management and protection of property or for the conduct of other legitimate business may, upon written application to the County Engineer, be granted a general permit for the operation thereon of certain classes or types of vehicles . Any such permit granted by the County Engineer shall not relieve the permittee from responsibility caused by their indiscriminate use thereof. |
Should an applicant desire to appeal the decision of the County Engineer to deny a general permit request under this section, such appeal must be made to the Board of County Commissioners, in writing, within five (5) calendar days of the County Engineer's decision. |
6. VIOLATION-MISDEMEANOR - As passed by Ordinance No. 2003-03, violations of any resolution by the Columbia County Board of Commissioners closing a county road, or limiting the classes or types of vehicles allowed on any county road or bridge enacted in compliance with RCW Title 36, shall be punishable as Criminal Trespass in the Second Degree, as designated in the Criminal Code RCW 9A.52.080. |
